DA's office had been counting on a DVD with the recorded testimony of a victim in case against a serial rapist, but when they popped the video into the player, nothing came up — the disc was blank. To make matters worse, the cop who performed the original interview with the victim told the DA she never said she was 'forced,' so the judge wasn't going to allow the witness to testify in a case where her original statement to police was in conflict with her current testimony. After two local data recovery firms said there was no way to restore the data, a third was able to recover the police interview from two years earlier, which led the defendant to plead guilty earlier this month. Close call."

An anonymous reader was one of several to note a bizarre story in which an Australian judge ruled that drawings can be child porn. In this case, it was knock off drawings of the Simpsons doing naughty things. Good thing they're going to be censoring the Down Undernet soon. Who knows what damage this could cause.

The Bush administration and the Electronic Frontier Foundation are poised to square off in front of a San Francisco federal judge Tuesday to litigate the constitutionality of legislation immunizing the nation's telecoms from lawsuits accusing them of helping the government spy on Americans without warrants. "'The legislation is an attempt to give the president the authority to terminate claims that the president has violated the people's Fourth Amendment rights,' the EFF's [Cindy] Cohn says. 'You can't do that.'"

Novell in, and SCO millions of dollars in the hole to Novell, it seemed like the fat lady had finally sung. But like most things in the legal system, it isn't nearly that simple. O'Reilly Media sought out Groklaw's Pamela Jones, and got a rundown of what's still alive, and why a final end to the madness may be many years away. 'Summing up, it looks bleak for SCO at the moment, but let's enter the alternate realm of SCO's best-case scenario in its dreams: in that realm, SCO wins on appeal, which one of SCO's lawyers indicated might take a year and a half or five years, and the case is sent back to Utah for trial by jury, which is what SCO wanted (as opposed to trial by judge, which is what it got), then everything listed above (except for the IPO class action) comes alive again, presumably, depending on what the appellate court decides. Then SCO is in position once again to go after Linux end users, as well as IBM, et al.'"

theodp writes "Nine years ago Monday, Amazon kicked off the Holiday Season by slapping Barnes and Noble with a court injunction barring BN from using a checkout feature that Amazon said represented illegal copying of its patented 1-Click technology. 'We're pleased that Judge Pechman recognized the innovation underlying our 1-Click feature,' said Jeff Bezos in a press release. But an Appellate Court wasn't quite as impressed with Amazon's innovation. Nor were USPTO Examiners who were asked to take another look at the merits of Amazon's 1-Click patent claims. Still, 1-Click lives on, although Amazon's lawyers are currently fighting two separate rejections by USPTO Examiners, burying USPTO Examiners in paper, and employing canceling-and-refiling tactics that some may find reminiscent of Eddie Haskell's chess end-game strategy. So much for Amazon-led patent reform."

NewYorkCountryLawyer writes "In one of the RIAA's 'John Doe' cases targeting Boston University students, after the University wrote to the Court saying that it could not identify three of the John Does 'to a reasonable degree of technical certainty,' Judge Nancy Gertner deemed the University's letter a 'motion to quash,' and granted it, quashing the subpoena as to those defendants. In the very brief docket entry (PDF) containing her decision, she noted that 'compliance with the subpoena as to the IP addresses represented by these Defendants would expose innocent parties to intrusive discovery.' There is an important lesson to be learned from this ruling: if the IT departments of the colleges and universities targeted by the RIAA would be honest, and explain to the Courts the problems with the identification and other technical issues, there is a good chance the subpoenas will be vacated. Certainly, there is now a judicial precedent for that principle. One commentator asks whether this holding 'represents the death knell to some, if not all, of the RIAA's efforts to use American university staff as copyright cops.'"

GameSetWatch is running a feature discussing the value of graphics styles in games. The authors point out that while certain genres, such as first-person shooters, benefited immensely from the advent of 3-D graphics, some types of games didn't handle the transition as well. A player's perspective, and his interaction with the game's camera, can often make or break an otherwise excellent release. "Before making the full jump to 3D, many genres made a move from classic 2D to isometric 2D as an intermediary step. For example, the original Civilization had a traditional top-down grid view while Civ 2 had a three-quarters isometric view. While this new perspective gave the game world a more life-like appearance, the change did come at a cost to the user's game experience. Namely, distances are much more difficult to judge on an isometric grid as the east-west axis takes up twice as many pixels as the north-south axis. To solve this problem, for Civ 4, our 3D perspective actually hearkened back to the original game as we showed the game's grid straight ahead and not at an angle. The easier the players perceive the grid through the graphics, the better they can 'see' their possible decisions."

damn_registrars writes "A US District judge has awarded $873 million dollars to Facebook in a default judgment against a spammer who sent messages to Facebook users about drugs and sex. This is the highest award so far in a civil suit under the CAN-SPAM Act."

A Colorado judge has come up with a way to ensure noise polluters learn their lesson. He forces them to listen to Barry Manilow. Four times a year, Judge Paul Sacco forces noise ordinance violators to sit in a room and listen to one hour of hits from Barry Manilow and Barney, the purple dinosaur. "These people should have to listen to music they don't like," Mr Sacco said.
